The CLARITY Act just failed to advance in the U.S. Senate.

But this does not mean crypto regulation is dead.

If Congress can’t deliver a comprehensive framework, the SEC and CFTC still have room to shape the market through existing authority, rulemaking and regulatory guidance.

The bigger issue is that the industry still lacks a durable federal framework clearly defining where SEC and CFTC jurisdiction begins and ends.

So the next phase may be less about Congress passing one big bill and more about regulators building the rules piece by piece.

THE BLOCK: The US CFTC filed a motion to dismiss in the lawsuit brought by the CME, regarding the agency’s decision to classify perpetual futures contracts as futures contracts rather than as swaps. The CFTC said that the CME “lacks standing,” arguing that its allegations of competitive harm were empty because the CME could list the perps itself.
“This lawsuit is a lot of noise for nothing,” the CFTC said.
