THE BLOCK: The US CFTC filed a motion to dismiss in the lawsuit brought by the CME, regarding the agency’s decision to classify perpetual futures contracts as futures contracts rather than as swaps. The CFTC said that the CME “lacks standing,” arguing that its allegations of competitive harm were empty because the CME could list the perps itself.
“This lawsuit is a lot of noise for nothing,” the CFTC said.
