Congress stumbles. Regulators didn’t wait.
The CLARITY Act — which aimed to give U.S. crypto markets an initial federal regulatory framework, splitting oversight between the CFTC and the SEC — failed this week on a procedural vote in the Senate. It needed 60 votes and didn’t reach that threshold. Senator Lummis, one of the leading negotiators, said the chances of passage this year are virtually nil.
The CFTC responded by sending a first batch of proposed crypto regulatory rules to the OIRA office in the White House for review, without waiting for Congress. The text has not yet been published, but the goal is clear: to build a framework for regulating derivatives based on its existing authority.
At the same time, the SEC moved in parallel, proposing an exemption that would allow platforms to trade tokenized U.S. equities on the blockchain without registering as national exchanges.
Treasury Secretary Bessent previously described regulators’ rulemaking stance as a backup option. According to Decrypt, it now appears to have become the primary one.
