Controversial decision on AI provision in US Senate budget bill
Sen. Elizabeth MacDonough ruled late Saturday that Republicans can maintain a 10-year moratorium on state and local artificial intelligence (AI) regulations in Congress’s sweeping tax and spending bill.
Commerce Committee Chairman Ted Cruz (R-Texas) has tweaked the AI ban to fit the Senate budget rules. Under the bill, states and localities would lose billions of dollars in federal broadband expansion funds if they enact any AI regulations over the next decade. This is a surprise victory for Republicans, according to Bloomberg.
Objections from many conservative MPs
Sens. Josh Hawley (Missouri) and Marsha Blackburn (Tennessee) joined Democratic opponents, arguing that states should have the right to protect their residents. Hawley also said he would work with Democrats to introduce an amendment to remove the hold when the bill is considered in the full Senate.
Blackburn also emphasized last week that, “We don’t need a moratorium on state autonomy on AI.”
Impact and response of political groups
In the political arena, members like Rep. Marjorie Taylor Greene (Georgia) and the House Freedom Caucus have threatened to oppose H.R. 1 if the 10-year moratorium remains in place. Greene has warned that she will oppose the bill unless the AI language is removed.
The decision favors tech companies that want to delay new AI safety laws, reducing the hurdles through the Senate budget process. States that violate new AI regulations will lose federal broadband funding.
Senators can challenge the moratorium on the floor, and ending it requires only a simple majority vote.
The role of budgets and AI regulatory approval criteria
For Democrats, MacDonough has emphasized that other options are inconsistent with budget rules, such as requiring states to match food aid money or forcing parties suing the federal government to take large stakes in temporary court orders.
With the July 4 deadline looming, Senate leaders are expected to vote on the spending bill this week. Negotiators are working behind closed doors to finalize the details, while the Senate Budget Committee is expected to provide occasional public updates.
