In 2018, former SEC director William Hinman stated that Ethereum and Bitcoin are not securities, but Gensler in 2023 evaded a clear answer about the classification of ETH.

Timmons demands the disclosure of documents, including the memorandum 'Analysis of Ethereum 2.0 under the Howey Test' and correspondence related to the 'ETH 2.0' investigation. These materials may shed light on the SEC's shifting position, especially after the approval of spot Ethereum ETFs in 2024, which contradicted the regulator's previous doubts. Transparency, according to Timmons, is necessary to advance the CLARITY Act, which clarifies cryptocurrency regulation.
