Last week, the market gave great attention to the approval of the first Brazilian Artificial Intelligence (AI) law. Determined to make the state of Goiás the national hub for technological development, the state government took a step towards regulation and sanctioned Complementary Law 205/2025, a text for promoting local innovation development in AI.

However, for Karim Kramel, a lawyer specializing in Digital Law, the Goiás regulation may not be effective and could still generate high costs for companies that rush to develop their activities relying on the prerogatives of the state law.

"Since there is still no federal regulation, the state can exercise its constitutional legislative prerogative and create the law, but as soon as the federal regulation – which is already in progress in Congress – is approved, it may be necessary to adapt the state regulation," explains the lawyer.

The new regulation in Goiás establishes guidelines for the responsible use of AI in public and private sectors, prioritizing open source solutions, data protection, digital inclusion, and regional development.

According to Kramel, this is, however, a transitional scenario and companies need to be attentive.

"The approval of the national law could lead to the revision or even revocation of the state law, and companies that rush to develop their activities relying on the prerogatives of the state law may have to bear financial, regulatory, and operational burdens to comply with the federal regulation," concludes the specialist.
