Trump Plans Executive Order Targeting Flag Burning Acts
Former President Donald Trump plans to sign an executive order on Thursday that would make burning the American flag a crime, according to a NewsNation report.
The draft order tells the Justice Department to look at charging people who burn flags with crimes like disorderly conduct, public nuisance, or even environmental violations. Punishments could include at least one year in federal prison.
However, the U.S. Supreme Court has ruled twice — most recently in 1990 — that burning the flag is a form of free speech protected by the Constitution. This means Trump’s order would almost certainly face legal challenges right away.
