After the U.S. Secretary cites the chance of sanctions against Moraes, Gilmar Mendes criticizes the action of 'foreign agents'

Minister Gilmar Mendes of the Federal Supreme Court (STF) stated this Thursday that it cannot be admitted that "foreign agents restrict the exercise of domestic jurisdiction" in the protection of "constitutional guarantees". The statement came after U.S. Secretary of State Marco Rubio declared that there is a "great possibility" that Minister Alexandre de Moraes will receive sanctions from the American government.

In a post on X, Gilmar did not make a direct reference to Rubio or Moraes but said that the "regulation of digital platforms and the establishment of parameters for hateful speech constitutes a fundamental element of national sovereignty for any contemporary nation". The American government has already criticized Moraes' decisions to suspend profiles on social media.

For Gilmar, it is up to each country to decide how to "safeguard democratic precepts" and the "Brazilian experience has shown in recent years that echo chambers and extremist manifestations erode republican foundations".

"It cannot be admitted that foreign agents restrict the exercise of domestic jurisdiction in the guardianship of constitutional guarantees. Normative autonomy represents an imperative of democratic self-determination," concluded the STF minister.

Marco Rubio's statement occurred on Wednesday during a testimony before the House Foreign Relations Committee. A Republican congressman criticized what he called "widespread censorship and political persecution" and questioned whether Moraes could be targeted by the Magnitsky Act, used against individuals accused of corruption or serious human rights violations.
