The defense has asked a judge to sentence Eric Council Jr., who is accused of posting a false message about the U.S. Securities and Exchange Commission (SEC) approval of a Bitcoin exchange-traded fund (ETF). Council’s legal team filed a lawsuit in the District of Columbia on May 13, asking for a sentence of no more than one year and one day in prison after he pleaded guilty. Council was part of a team that controlled the SEC’s X account through a SIM swap attack in 2024, posting a message claiming that the agency had approved the listing of the first spot Bitcoin ETF.

“A sentence of one year and one day is sufficient to punish the defendant and deter future criminal behavior,” the May 13 filing stated. Council initially denied the charges but pleaded guilty in February to conspiracy to commit aggravated identity theft and access device fraud. Judge Amy Berman Jackson asked prosecutors to identify the charges and indicate the information in the filing by May 13.

Prosecutors have sought a two-year sentence for Council, arguing that he “profited through an elaborate fraud scheme.” Court records show that Council made about $50,000 from similar SIM swap attacks. While Council’s trial appears to be coming to an end, the District of Columbia could soon see a leadership change that could impact the prosecution of cryptocurrency-related cases. On May 8, President Donald Trump announced that Jeanine Pirro would become acting district attorney.
