The SEC’s Division of Corporation Finance issued new instructions dated November 13, aimed at providing transparency to ETF issuers especially those who filed during the shutdown.


Key clarification:

If issuers included language under Rule 473(b), or filed a new registration without a delaying amendment, their ETFs will automatically go effective after 20 days, similar to what happened with the Solana, Litecoin, HBAR, and XRP ETFs that became auto-effective during the shutdown.


The SEC reminds issuers that registration statements must be accurate, complete, and not misleading, even if they will become effective automatically.

Spot ETF Flow Update – November 12

The market saw a notable cooldown in ETF activity today, with both Bitcoin and Ethereum products posting sizable net outflows.
For Bitcoin, spot ETFs collectively shed $278M, ending a two-day streak of inflows. Fidelity led the weakness with $132.86M leaving, followed by Ark Invest at $85.18M.

Ethereum ETFs also reflected strong selling pressure, recording $183.86M in total outflows. BlackRock products accounted for $91.09M, while Grayscale followed with $49.35M. This marks the second straight day of negative flow for ETH ETFs, bringing the two-day drain to $291.25M.

Interestingly, all 11 US-listed Bitcoin ETFs and all 9 Ethereum ETFs either saw capital exit or remained flat — a rare synchronized shift across the board.
