SEC Targets Clarity and Innovation in Overhaul of Digital Asset Regulation
Growing demand for clarity around digital asset regulation is prompting a significant shift at the U.S. Securities and Exchange Commission (SEC), with a focus on innovation over enforcement. SEC Chair Paul Atkins signaled a sharp turn in regulatory posture during a July 2 appearance on CNBC, where he laid out the agency’s new approach to crypto and blockchain-driven financial products. Describing ongoing work with both the administration and Congress on updated legislation, he stated:
We have a really good program now addressing the crypto markets.
Rather than hindering industry development, he argued for a constructive path forward that moves beyond the SEC’s prior methods: “Tokenization is an innovation, and we at the SEC should be focused on how do we advance innovation in the marketplace. And so, I would argue here, over the last several years, the SEC has been standing athwart efforts to innovate in the marketplace because things have been unclear. The rules have not been clear. We’ve had regulation through enforcement.”
Atkins views tokenization as a technological evolution that can reduce costs, improve trade finality, and streamline capital formation. The SEC Chair explained:
Tokenization and other aspects of doing the tokenization in the marketplace is yet the next step to have much more efficiency in the marketplace and certainty of having a trade settle.
He reinforced the idea that the SEC will support this progress by giving market participants a transparent regulatory structure. Even while embracing innovation, Atkins maintained that the agency’s vigilance on fraud remains unchanged. He reaffirmed that investor protection remains central to the SEC’s mission, with the goal of ensuring fair access and responsible development across crypto and traditional markets.
