The SEC case will NOT be delayed until August 15. The district court judge may decide on the pending motion before her in hours, days, or weeks (or months or years, in that case, but obviously it won't come to that).

These rumors and the statement from the former SEC lawyer arise after the latest update on the XRP lawsuit. After re-filing a motion for summary judgment, Ripple and the SEC submitted a status report requesting the court to postpone the appeal process until August 15. Since the SEC is expected to submit another status report on August 15, this has generated speculation about a possible delay in Judge Torres' decision.

Additionally, Fagel clarified the uncertainty surrounding the settlement of the Ripple vs. SEC case. He stated that he could not predict the outcome of the case, citing its unprecedented nature. He noted:

"I cannot predict the judge's ruling. This is unprecedented—possibly the first time that the SEC changes administration and seeks to overturn a judicial victory—and the court could rule in any direction. If she denies the motion, Ripple will have to decide whether to proceed with its appeal."
