Documents submitted by the defense team for Roman Storm, the lead developer of Tornado Cash, revealed that prosecutors were aware since 2023 of FinCEN reports (Financial Crimes Enforcement Network) confirming that non-custodial cryptocurrency mixing platforms are not classified as 'money transmission businesses' under U.S. law.

The defense pointed out that these documents show that the accusations made are incorrect and that crucial evidence has been withheld that could change the course of the case. The lawyers also relied on the legal precedent of the Samurai Wallet case, where the developers were acquitted based on the same arguments, urging the court to reconsider its previous decision.

For its part, the public prosecutor's office denied any misleading or concealment of evidence, confirming that it provided all the required documents within the specified deadlines.
