As reported by Forbes journalist Eleanor Terrett, the draft states on page 49 that transactions involving the sale of digital commodities are not considered securities, as long as the transactions do not grant ownership rights to the buyer in the business, profits, or assets of the issuer. Essentially, buying and selling digital commodities in the secondary market, rather than directly from the issuer, will not automatically trigger US securities laws unless the sale grants ownership or claims on the profits or assets of the company.
