The SEC staff has been instructed to draft clear rules for the allocation, custody, and trading of cryptocurrencies. Most crypto assets are not considered securities. Guidelines are being developed to determine when a crypto asset qualifies as a security. Additionally, the staff has been asked to propose disclosure requirements and exemption provisions for crypto assets identified as securities. The SEC is also engaging with companies seeking to issue tokenized securities.
