Important Info for P2P Merchants in Bangladesh Facing Account Freezes Recently, I went through a tough experience that I feel every P2P merchant in Bangladesh should know about. If your bank account ever gets frozen due to cyber complaints or Layer 4 credits, this might help you. 🔍 What I Learned from a Court Ruling (Madras High Court – W.P. No. 25631 of 2024): Banks are allowed to freeze only the disputed transaction amount, not the entire account. Freezing the whole account is actually illegal. In my case, ICICI Bank had frozen my full account. After 8 long months, the court finally ordered them to keep only ₹175 blocked (the disputed amount) and unfreeze the rest. ❗ But then another issue came up — my Federal Bank account got frozen again for a small Layer 4 credit. No prior notice, no explanation, just a complete debit freeze. 📌 Here’s What I Did: 1. I asked the bank under which section the police had sent the freeze notice: Section 91 CrPC → Police can only ask for account details, not freeze. Section 102 CrPC → Police can freeze, but they must inform a magistrate within 2 months. In my case, the police never informed the magistrate, which technically made the freeze illegal. ✅ Takeaways for Other Merchants: Always ask your bank under which section the freeze was ordered. If it’s under 91 CrPC → not valid for freezing. If it’s under 102 CrPC → ask for proof that a magistrate was informed. If the freeze looks illegal, you can even file a writ petition (just like the Madras HC case). We P2P merchants need to be more aware of our rights. Don’t just accept freezes silently — always question and fight back if needed. 💪 Let’s support each other and spread awareness.
