The General Corregedoria of Justice of the State of Santa Catarina prohibited "the real estate registry officer from making any annotation, averment, or registration that links the real estate registration to digital tokens, representations in blockchain, or any other extrajudicial instrument, with or without the intention of representing the ownership of the domain."

ABToken opposes restrictions on registries regarding real estate via blockchain
Tonight, ABToken expressed its opposition to Circular No. 410, of August 18, 2025. The document establishes an explicit prohibition on linking real estate registrations to digital tokens, representations in blockchain, or other instruments.
ABToken regrets the prohibition of registering tokens in real estate registrations, as it believes that the use of blockchain and DLT technologies brings enormous security to real estate transactions and prominence to the real estate registration service in Brazil.
For the association, the service of registering movable assets is essential and has a direct connection with the legal security necessary in transactions involving real estate.
However, blockchain technology reinforces these points and is undeniably one of the most important infrastructures in recent years. In terms of the new construction of registration systems and the modernization of the financial system in our country, tokenization today represents a way to guarantee millions of citizens access to investments and better utilization of their movable and immovable assets, as well as a more inclusive dynamic in the financial market, details the note of repudiation.
Setback for Brazil
For ABToken, the prohibition of real estate tokenization via a measure motivated by the lack of knowledge of the positive, social, and economic impacts represents a huge setback.
Brazil has been representing the sector globally in an expressive way, being at the forefront of innovation. However, measures like this can significantly delay the natural development of the market due to digital transformation.
Regina Pedroso, Executive Director of ABToken emphasizes that the institution "has always been open to dialogue, working hard to provide quality information on the security of transactions carried out through decentralized technology, in distancing from crime and in regulatory work together with regulators and legislators in Brasília. We still believe that real estate registration is essential, but regret the lack of openness to innovation."
