Summoned in the USA, Alexandre de Moraes was not going to accept the summons (the STJ is the one who should forward it and can deny the request). But now Moraes has the chance to annul the process:
Documents and cell phone messages from the former president indicate contacts with an American lawyer regarding the case against the minister in Florida. The case was brought by a Trump company and the Rumble platform. This political-personal interest could lead to the annulment of the cause:
Data from the Federal Police indicate that Jair Bolsonaro may be involved with the case filed against Alexandre de Moraes in the United States by Trump Media and the Rumble platform. The action, opened in February in a court in Tampa, Florida, is part of the offensive sponsored by American President Donald Trump to try to force the end of the process in the STF.
There were exchanges of messages between Bolsonaro and the lawyer who represented Trump's company in the action, identified as "Martin de Lucca USA" in the former president’s phone contacts!!!!
In addition to discussing the case, they also talked about posts on social media. The lawyer actually created an online profile and began attacking the STF minister.
The actions of both are very recent: in the operation on July 18, the Federal Police seized a printed and translated version of a petition sent to the judge of the Rumble case by Trump Media's lawyer on July 14. This translation was compared to the original petition of the case, "identifying its similarity."
According to the Federal Police, other documents and messages "indicate a scenario of previously agreed actions between Jair Bolsonaro and the Rumble lawyer."
Moraes can thus request the nullity of the American action based on this diversion of purpose of the process (to benefit Bolsonaro in Brazil and not to guarantee the rights of American companies).
Attempting to deceive Justice and induce the judge is referred to in Brazil and the USA as bad faith litigation.
