XRP, the third-largest cryptocurrency by market cap, has surged above $3 for the first time in over a week amid growing speculation that the U.S. Securities and Exchange Commission (SEC) may drop its long-running case against Ripple Labs.

According to Cointelegraph data, XRP gained more than 4.5% in the past 24 hours on Aug. 8, breaking the key $3 psychological barrier. Investor sentiment has been lifted by expectations of regulatory clarity and the potential dismissal of the SEC’s appeal.

Aug. 15 Could Mark a Turning Point

Lawyer Bill Morgan predicted on X that “the dismissal of the appeals may happen — and is more likely than not — before the Aug. 15 deadline to report to the appeal court.” He noted that Ripple had already agreed to drop its appeal in the past and that both parties had previously signed a conditional settlement, though conditions were unmet at the time.

The SEC and Ripple are due to file a joint status report with the U.S. Court of Appeals for the Second Circuit by Aug. 15. If the court approves, the appeal could be dismissed and the settlement finalized, sending the case back to the district court for final authorization.

The SEC sued Ripple in December 2020, alleging it raised $1.3 billion through unregistered XRP securities sales. In July 2023, Judge Analisa Torres ruled that XRP was not a security in retail sales but was in institutional sales, imposing a $125 million fine in August 2024.

On June 12, 2025, Ripple and the SEC jointly moved to release $125 million held in escrow to pay the court-ordered settlement, with $50 million going to the SEC and $75 million returned to Ripple upon approval.

8일(현지시간) 코인텔레그래프 데이터에 따르면, XRP는 24시간 동안 4.5% 이상 상승하며 3달러 심리적 저항선을 회복했다. 투자 심리는 규제 불확실성 완화와 SEC 항소 기각 가능성에 대한 기대감으로 강화됐다.

8월 15일, ‘결정적 보고서’ 제출 예정

변호사 빌 모건(Bill Morgan)은 X(구 트위터) 게시글에서 “8월 15일 항소 법원에 제출할 상태 보고서 이전에 SEC가 항소를 철회할 가능성이 높다”고 전망했다. 그는 이미 리플이 항소 취하에 동의했으며, 양측이 조건부 합의서에 서명한 전례가 있다고 덧붙였다.

SEC와 리플은 8월 15일까지 미국 제2순회항소법원에 공동 보고서를 제출해야 한다. 보고서 내용에 따라 항소 취하 및 합의안 최종 확정 절차가 진행될 수 있다. 승인 시 사건은 최종 인가를 위해 지방법원으로 환송된다.

2020년부터 이어진 ‘최장기 소송’

SEC는 2020년 12월, 리플이 13억 달러 규모의 미등록 증권(XRP) 판매를 통해 자금을 조달했다고 주장하며 소송을 제기했다.

2023년 7월, 아날리사 토레스(Analisa Torres) 판사는 개인 투자자 대상 판매는 증권에 해당하지 않지만, 기관 판매는 미등록 증권 판매에 해당한다고 판결했다. 2024년 8월, 리플은 1억 2,500만 달러의 벌금을 부과받았다.

올해 6월 12일, 리플과 SEC는 벌금 지급을 위한 1억 2,500만 달러의 에스크로 자금 해제를 공동 요청했다. 합의안에 따라 5천만 달러는 SEC에, 나머지 7,500만 달러는 리플에 반환될 예정이다.
