Trump determined this qualifies as an escalation of the national emergency declared under prior executive orders (14024 and 14066), authorizing a 25% ad valorem duty on Indian-origin imports, effective 21 days after issuance (i.e., starting around August 27, 2025) .
This duty is stacked on top of existing "reciprocal tariffs" (initially set at 25%) previously imposed under Executive Order 14257 of April 2, 2025 .
The order includes carve-outs (e.g. for goods already loaded or already entered before the effective period) and aligns with legal authority under IEEPA, the Trade Act of 1974, and the National Emergencies Act.
