Smith was appointed as special prosecutor in November 2022, responsible for the investigation and litigation of Trump's alleged attempts to overturn the 2020 presidential election results and the improper handling of government confidential documents. Trump faces criminal charges in both cases. After the results of the 2024 presidential election were announced, Smith submitted materials to the U.S. federal court, dropping the charges against Trump. In the documents, he stated that the U.S. Constitution requires that criminal proceedings against a president-elect should be terminated before taking office.
