STF splits after attempt at a letter in defense of Moraes
Minister Alexandre de Moraes sought unanimous support from his STF colleagues after being sanctioned by the United States via the Magnitsky Act. The proposal included a collective letter signed by all the magistrates — but the majority of the 11 ministers deemed the initiative inappropriate and refused to endorse the document.
Without consensus, it was decided to issue only an institutional note, with a neutral tone, signed by the president of the Court, Luís Roberto Barroso, who did not even mention the USA.
On Thursday (July 31), the Palácio do Planalto organized a dinner at the Palácio da Alvorada in an attempt to reinforce unity among the magistrates with the presence of President Lula. However, only six ministers attended: Moraes, Barroso, Cristiano Zanin, Edson Fachin, Flávio Dino, and Gilmar Mendes — five abstained.
The episode exposed a clear split in the STF: an important group of the Court rejected the joint manifesto, which would frustrate Moraes's attempt to demonstrate institutional solidarity.
