Classification of cryptocurrencies: Are they commodities or securities?
By nature, cryptocurrencies are complex and take multiple forms. The fundamental challenge lies in determining whether the digital asset is considered a commodity (subject to the oversight of the Commodity Futures Trading Commission - CFTC) or a security (subject to the oversight of the Securities and Exchange Commission - SEC).
The law aims to clarify this classification, but the question of "when does the asset transition from being a security to a commodity" remains a contentious point, which may lead to varying interpretations.
