The Never-Ending Legal Battle Between Ripple and SEC
The long-standing legal battle between Ripple and SEC just had a surprising twist. In a recent development, Judge Analisa Torres denied the joint request from both Ripple and SEC for leniency in penalties and the removal of current restrictions.
The application was a signal that the case was nearing a settlement, and both parties were ready to put the past behind. However, Judge Torres rejected it, stating that the parties did not provide sufficient reasons to change her previous ruling.
Is Politics Interfering?
This decision surprised many. Attorney Fred Rispoli, who closely follows the lawsuit, shared that he fully expected Judge Torres to approve this request. He believes it would be an easy way for the judge to acknowledge the SEC's previously strict approach to cryptocurrency, especially under Gary Gensler.
However, after the application was denied, Rispoli provided two plausible reasons:
First, Judge Torres may have grown tired. The lawsuit has dragged on for over four years, with countless delays, heated disputes, and wasted time in court. She may be sending a message that it is time to stop with the accommodations for both parties.
Second, and this is interesting, Rispoli emphasized that politics may be playing a role. He explained that in the U.S. legal system, some judges silently resist any ruling government.
Rispoli does not assert that Judge Torres is doing this, but this is a hypothesis he wants to test through how she handles other cases in the future.
A Missed Opportunity for Ripple and SEC
The language that Judge Torres used in the denial is an issue for both Ripple and SEC. In her ruling, she reiterated the SEC's previous statements that Ripple's actions were reckless and deserving of a $1 billion penalty.
Currently, the case continues as planned in the appellate court. The next official update is expected in August 2025, when both parties must submit a status report. Many in the XRP community still hope for a settlement before then, but the recent ruling suggests the road ahead may be bumpier than expected.
