Texas Governor Greg Abbott signed SB 21 into law on June 21, 2025, establishing the Texas Strategic Bitcoin Reserve. This is a major step, making Texas the third US state to establish a strategic cryptocurrency reserve.

Previously, on June 1, 2025, Texas received SB 21 from the Legislative Council. According to the Texas Constitution, if the government does not veto it by June 22, the law will automatically take effect. The official signing confirms that Texas is upgrading its Bitcoin reserve strategy.

Texas Bitcoin Reserve Fund Management and Market Standards

Under SB 21, the Texas Bitcoin Reserve Fund will be managed by the Department of Financial Management, outside of the state budget. It will be funded by legislative appropriations, special service fees, investment profits, and cryptocurrency giveaways. The provision clearly outlines the strategy for buying, selling, and holding these digital assets.

Investment Policy and Market Safety for Texas Bitcoin Fund

Only cryptocurrencies with an average market capitalization of at least $500 billion over the past 12 months are eligible for investment. This is to ensure that the fund only targets large, stable coins, of which Bitcoin is the current representative.

The biggest changes to the bill through its various readings are clearer guidelines, new risk controls, and limits on the authority of the regulator to spend public funds to avoid excessive speculation.

Previously, Texas passed House Bill 4488, which prevents Bitcoin reserves from being transferred to the general fund. This is a legal step that creates a basis for owning digital assets under state law.

While HB 4488 protects the fund, SB 21 actually allows the state to establish a Bitcoin reserve fund, which allows the department to use surplus revenue to buy cryptocurrencies with a market value of at least $600 billion, currently only Bitcoin qualifies.
