Solemn reminder of the applicable law
Article 33, paragraph 3, of the law of July 29, 1881 on freedom of the press, which punishes public insults "against a person or a group of persons because of their origin or their membership in a particular nation" with one year of imprisonment and a fine of €45,000;
Articles 225-1 and 225-2 of the Penal Code, which prohibit any distinction or act aimed at or resulting in harming a person due to, in particular, their origin or their supposed membership in a Nation; the sanction can go up to three years of imprisonment and €45,000 in fines;
Article 29 of the same 1881 law, defining insult as "any offensive expression, term of contempt or invective" not preceded by an allegation of a specific fact;
The following statements have been made:
> "Without us you have nothing; since our departure you have not evolved, so well..."
They attribute to a group of people from formerly colonized territories an alleged economic, social, and intellectual inferiority;
They thus establish a hierarchy between peoples based on colonial history and national origin, which inherently undermines the dignity of these individuals;
Considering that such statements characterize:
1. A public insult of a racist or xenophobic nature, punishable under the aforementioned article 33;
2. Discrimination based on origin or nationality, prohibited by articles 225-1 and 225-2 of the Penal Code.
For these reasons
1. It is reminded that freedom of expression does not protect either racist insults or discrimination;
2. The authors expose themselves to the aforementioned criminal prosecutions, in addition to civil damages for the moral harm caused;
3. It is asserted that these statements are legally and morally intolerable.
