CoinVoice has recently learned that, according to a report by CoinDesk, Coinbase has obtained and disclosed a batch of internal communication documents from the U.S. Securities and Exchange Commission (SEC) through the Freedom of Information Act (FOIA), which show that the New York State Attorney General's Office requested the SEC to clarify the classification of Ethereum (ETH) as a security during the lawsuit against KuCoin in 2023.
Shamiso Maswoswe, the Director of the New York Investor Protection Bureau, stated in a letter that she hopes the SEC will submit an amicus brief to support the view that ETH is a security, in order to enhance investor protection. However, the SEC ultimately did not adopt this request, but the document revealed the internal discussions of the regulatory agency regarding the classification of ETH, especially after Ethereum's transition to the PoS consensus mechanism.
