Deep Tide TechFlow News, on May 7, according to CoinDesk, internal communication documents of the U.S. Securities and Exchange Commission (SEC) obtained by Coinbase through the Freedom of Information Act show that the New York Attorney General's Office requested the SEC to publicly declare Ethereum's native token ETH as a security rather than a commodity during the lawsuit against KuCoin in 2023.

Shamiso Maswoswe, Director of the New York Investor Protection Bureau, stated in the request that while the classification of ETH's nature has little impact on the case in New York, from an investor protection perspective, having the court recognize ETH as a security would be more beneficial.
