In a landmark decision, the UK High Court of Justice delivered a mixed ruling in the high-profile intellectual property dispute between Getty Images and Stability AI. Filed in 2023, the case revolved around whether Stability AI’s Stable Diffusion model infringed Getty Images’ trademark and copyrighted content. While the court acknowledged instances where watermarks were reproduced, it emphasized that the findings were limited in scope and did not establish broad copyright infringement.

Justice Joanna Smith highlighted that Getty Images failed to prove that any UK-based users had actively reproduced the watermarked images a key requirement under UK law for primary infringement. Additionally, claims of secondary infringement were dismissed, as Stable Diffusion does not store or reproduce images directly, which means it does not constitute an infringing copy under the UK’s Copyright, Designs and Patents Act (CDPA) of 1988. This ruling clarifies that AI models generating new outputs do not automatically violate copyright simply because they were trained on copyrighted works.

The decision reflects a wider global trend. In the U.S., Judge William Orrick similarly dismissed most copyright claims against AI platforms like Midjourney, DeviantArt, and Stability AI, noting that AI-generated images do not closely replicate the original works and therefore do not constitute copyright infringement.

With legal frameworks still evolving, creators face ongoing challenges in protecting intellectual property.
