The taxpayer seeks guidance from a specialist to know how to report gains and losses with crypto assets in the declaration

Are you in doubt about how to fill out your Income Tax declaration for 2025? In a certain investment fund in crypto assets, my situation was as follows:

• Situation on 12/31/2023: R$ 1,000.00

• Situation on 12/31/2024: R$ 1,500.00

In other words, I had a wealth evolution of R$ 500.00.

However, in the associated income (income subject to exclusive taxation), I am required to report this income of R$ 500.00, which in turn impacts the total in the 'Income Subject to Exclusive/Final Taxation' section.

My question is: what if, for example, in the declaration of the following year (in 2026), instead of a "gain", there is a "loss" in this same fund? For example:

• Situation on 12/31/2024: R$ 1,500.00

• Situation on 12/31/2025: R$ 800.00

In other words, my wealth evolution would have a negative fluctuation. And if I decide to withdraw this amount of R$ 800.00, with a loss of R$ 200.00 in relation to the initial capital invested, how should this be treated in the Response, by Priscilla Rama*:

"To declare this type of fund, the taxpayer must use the information provided in the Income Statement issued by the paying source. This is the official document and it must include the value of the asset and respective income.

However, the inclusion of the same in the list of assets and rights is done at its respective acquisition cost, without reflecting any potential gains or losses. Note also that in case of gains, the respective Income Tax is collected directly by the paying source, with exclusive and final taxation, that is, without adjustment in the Income Tax Declaration.

As for any eventual loss, the fund administrator can compensate internally, if there is another fund of the same tax class that they manage."
