Theo Odaily, a new draft discussion on market structure from the U.S. House of Representatives aims to clarify the classification of digital commodity transactions. As reported by Forbes reporter Eleanor Terrett, the draft specifies on page 49 that transactions involving the sale of digital commodities do not constitute securities, provided they do not grant ownership rights to the buyer in the business, profits, or assets of the issuer. Essentially, buying and selling digital commodities on the secondary market, rather than directly from the issuer, will not automatically trigger U.S. securities laws unless that sale grants ownership rights or rights to claim profits or assets of the company.
