#BitcoinWithTariffs A coalition of small businesses has filed a lawsuit against former President Donald Trump in an effort to halt recently imposed tariffs on foreign imports. The legal challenge, brought before the U.S. Court of International Trade, argues that Trump overstepped his authority by bypassing Congress's constitutional power to set tariffs. The plaintiffs contend that Trump's justification for the tariffs—claiming trade deficits with other nations amount to a national emergency—lacks any valid basis.
The lawsuit argues that Congress never granted the president such authority, stating, *“The statute the President cites—the International Emergency Economic Powers Act (IEEPA)—does not permit him to impose sweeping global tariffs unilaterally.”*
The Liberty Justice Center, representing the small businesses, warned that Trump’s tariffs—ranging from at least 10% on most imports to even higher rates for many nations—are crippling small businesses nationwide.
The filing dismisses Trump’s justification, declaring, *“His so-called ‘emergency’ is pure fiction. Trade deficits, which have existed for decades without economic harm, do not qualify as an emergency—much less an ‘unusual and extraordinary threat.’”*
The group also pointed out that the administration levied tariffs even on countries where the U.S. has no trade deficit, further exposing the policy’s flawed rationale.

“This Court should declare the President’s unprecedented power grab illegal, enjoin the operation of the executive actions that purport to impose these tariffs under the IEEPA and reaffirm this country’s core founding principle: there shall be no taxation without representation,” the suit says.
