A panel of three judges from the U.S. Court of International Trade unanimously ruled that President Donald Trump exceeded his authority by imposing tariffs under the guise of a national emergency according to the International Emergency Economic Powers Act (IEEPA) of 1977.
The court found that these tariffs exceeded the powers granted by IEEPA and violated the U.S. Constitution, which gives the power to tax to Congress.
It is likely that President Trump will appeal. The White House stated: "It is not the role of un-elected judges to decide how to properly respond to a national emergency."
The U.S. Supreme Court may be the final arbiter.
