According to Mars Finance news, on August 27, the Supreme People's Court and the Supreme People's Procuratorate of China published typical cases of punishing the concealment and hiding of criminal proceeds in accordance with the law, which included "An certain person and others using virtual currency and other means to conceal and hide criminal proceeds." From September to October 2020, defendants An certain person, Chen certain person, and Guo certain person conspired to profit by transferring funds for others through online platforms. An certain person contacted criminals from a telecom fraud group online (handled in another case) and provided multiple bank card accounts of Guo certain person to receive funds as instructed by the other party. After Guo provided the bank card accounts, he was responsible for registering and logging into the encrypted trading platform in his own name. Chen certain person was responsible for operating the trading platform to use funds transferred to Guo's bank card accounts to purchase virtual currency, which was then transferred to the virtual currency accounts designated by the other party, who paid commissions to An certain person and others according to the proportion. An certain person and others helped criminals transfer a large amount of funds in the aforementioned manner, which included verified funds defrauded from victims such as Tang certain person, Zhu certain person, and Tong certain person, totaling more than 500,000 yuan. The People's Procuratorate of Tongzhou District, Beijing, prosecuted defendants An certain person and others for the crime of concealing and hiding criminal proceeds to the People's Court of Tongzhou District. After trial, the People's Court of Tongzhou District found that based on the confessions of the three defendants and evidence extracted from the chat records on the phones involved in the case, it was sufficient to determine that the three defendants were aware that the funds they handled were criminal proceeds. The defendants An certain person and others knowingly used virtual currency and other means to assist in the transfer of criminal funds, constituting the crime of concealing and hiding criminal proceeds, and the circumstances were serious. Defendant An certain person was sentenced to three years and three months in prison and fined 40,000 yuan; defendant Chen certain person was sentenced to three years and three months in prison and fined 40,000 yuan; defendant Guo certain person was sentenced to two years and eight months in prison and fined 30,000 yuan. After the verdict, there were no appeals or protests, and the judgment has taken effect.
