The report sends a policy signal that regarding how to handle those virtual currencies seized in cases, Henan Province believes that it is inappropriate for local authorities to legislate on this matter. In the report, the Henan Provincial Legal Affairs Committee concluded that virtual currency has property attributes and belongs to involved property, and there is a basic consensus in judicial practice. However, virtual currency trading is completely banned in China, and there are no legal trading platforms; how to dispose of virtual currency is still being explored in various regions. Currently, the Ministry of Public Security is studying and formulating relevant systems for virtual currency, and the management of this new type of involved property is more suitable to be uniformly regulated at the national level, while local legislation should not make provisions.
