According to ChainCatcher, Zhao Changpeng requested the U.S. Delaware bankruptcy court to dismiss the $1.76 billion recovery claim lawsuit filed against him by the FTX trust. The trust claims that this fund was improperly transferred to Binance by SBF (Sam Bankman-Fried).
In a motion submitted on Monday, Zhao Changpeng stated that he is a resident of the UAE and that the trust cannot prove it falls under the jurisdiction of Delaware. He emphasized that the relevant claims have little connection to the U.S., and the laws involved have no extraterritorial applicability.
Previously, the trust and FTX Digital Markets sued Binance and several executives over a share repurchase agreement with SBF from July 2021. In July this year, two former Binance executives have applied to be removed from the lawsuit. Zhao Changpeng claimed that he was merely a 'nominal counterparty' and accused FTX of 'irrationally' blaming Binance for the bankruptcy.
He also pointed out that serving American lawyers to foreign defendants is improper conduct and can invalidate the complaint. Zhao Changpeng also stated that U.S. bankruptcy law does not explicitly apply to overseas fund transfers.
