After years of legal tension, the long-running case between Ripple Labs and the U.S. Securities and Exchange Commission (SEC) is nearing its end.
Ripple has officially withdrawn its cross-appeal, marking a turning point following months of intense negotiations and courtroom filings. The decision follows the court’s July 2023 ruling, which delivered a partial win for Ripple — determining that institutional sales of XRP violated securities laws, but programmatic sales (on exchanges) did not. In her opinion, Judge Analisa Torres also affirmed that XRP itself is not a security.
The regulatory landscape began to shift in 2024 after Donald Trump’s re-election, ushering in a more favorable climate for the crypto industry. With that momentum, the SEC resumed settlement discussions with Ripple and even indicated its willingness to lift the freeze on Ripple’s XRP sales.
However, Judge Torres rejected two revised settlement proposals, citing procedural issues and a lack of “exceptional circumstances” to justify deviation from standard procedures.
Rather than pursue further litigation, both parties have now opted to bring the case to a close.
