🧾 Trading crypto via a card? Congratulations — you are an entrepreneur. Even if you didn't know.
A legal precedent has emerged in Russia:
a guy was trading crypto via P2P, receiving ₽143 million on a personal card.
The court said:
"You are an entrepreneur, brother. Pay taxes under the simplified tax system (STS)."
💸 Income was calculated — 92.5 million.
📉 Taxes and fines assessed — over 5 million.
🧨 Because P2P, frequent transactions, third-party accounts — all of this is business.
👀 And here's what is now important:
✅ Entrepreneur — account for crypto as income under STS: 6% (income) or 15% (income minus expenses).
🚫 Individual — forget about "13% and go for it". This won't work.
⛔️ Self-employed — you can't legally sell crypto at all.
📌 Conclusion:
Now any P2P with regularity — it's not "I sent USDT to a friend", but "I did not declare my business".
And the tax authorities already know how to distinguish the first from the second.
It's time to step out of the gray zone. Or at least not keep ₽143 million there 😅
