According to PANews, the U.S. District Court for the Western District of Texas ruled that the sanctions imposed by the Treasury Department's Office of Foreign Assets Control (OFAC) against Tornado Cash were unlawful, and permanently prohibited their enforcement. Although OFAC removed Tornado Cash from the sanctions list in March 2024, Judge Robert Pitman noted that OFAC retains the intention to re-impose sanctions in the future and emphasized the need to enforce the decision of the Fifth Circuit Court of Appeals. Two developers of Tornado Cash still face criminal charges from the U.S. Department of Justice and remain on the OFAC sanctions list. This ruling only pertains to the protocol itself and does not involve the judicial proceedings against the developers.
