🏛️ SEC chuẩn bị “làm mới luật chơi” cho tài sản số

Chủ tịch SEC Paul Atkins vừa tiết lộ kế hoạch hiện đại hóa quản lý tài sản số trong khuôn khổ “Project Crypto.”
Cơ quan này dự định thiết lập hệ thống phân loại token dựa trên bài kiểm tra Howey, nhằm công nhận rằng hợp đồng đầu tư có thể kết thúc theo thời gian — nghĩa là, không phải token nào cũng mãi là chứng khoán.

Ông Atkins cho biết SEC sẽ xem hàng hoá số, vật phẩm sưu tầm số và token mạng lưới là ngoài phạm vi chứng khoán, trong khi chứng khoán mã hoá (tokenized securities) vẫn chịu quản lý nghiêm ngặt.
SEC cũng đang xem xét gói miễn trừ mới cho các đợt phát hành crypto gắn với hợp đồng đầu tư, đồng thời khẳng định: “Gian lận vẫn là gian lận.”

Dù chính phủ Mỹ đang tạm ngừng hoạt động, dự luật cấu trúc thị trường crypto vẫn tiến triển, hứa hẹn sẽ định hình lại khung pháp lý cho thị trường tài sản số trong thời gian tới.
